Can foreigners own property in Thailand?

Foreign nationals can own a condominium unit outright (freehold) up to 49% of a building's total foreign quota. For villas and land, ownership is structured through long-term leasehold (typically 30+30 years) or Thai company structures, advised on a case-by-case basis.

What is the difference between freehold and leasehold?

Freehold means you own the property outright with a title deed (Chanote) registered in your name. Leasehold grants exclusive usage rights for a defined term — typically 30 years, renewable. Both are legally sound and widely used by international buyers in Phuket.

Are there property taxes in Thailand?

Thailand has no capital gains tax for individuals. A Land and Buildings Tax applies annually at low rates (typically 0.02–0.1% of assessed value for residential use). Standard transfer fees and duties apply at the point of purchase.

How long does the acquisition process take?

From first consultation to completed transfer, a typical acquisition takes 4–10 weeks. New-build purchases may have longer timelines depending on construction stage and project milestones.

Can I rent out the property when I'm not using it?

Yes. Many of our clients generate rental income through managed programs when they are not in residence. We advise on the most effective rental structures for yield, flexibility, and legal compliance.

Do I need to be present in Thailand to complete the purchase?

Not necessarily. With a properly executed Power of Attorney, our legal partners can complete the transfer on your behalf. Many of our international clients finalise purchases entirely remotely.
