Frequently asked questions
Can foreigners own property in Thailand?
Foreigners who meet the statutory conditions may own a unit in a registered condominium, provided total foreign ownership does not exceed 49% of the condominium's aggregate unit area. Foreign ownership of land is generally restricted and any land, villa, lease or company arrangement requires independent Thai legal review; nominee shareholders must not be used to bypass the law.
What is the difference between freehold and leasehold?
Freehold is registered ownership of the relevant asset. A lease gives contractual rights for its registered term; under Thailand's Civil and Commercial Code, a lease of immovable property generally may not exceed 30 years. A future renewal is not automatic ownership and depends on a new enforceable agreement and registration, so it should not be valued as guaranteed.
Are there property taxes in Thailand?
Taxes depend on the owner, use, holding period and transaction. An individual's gain or proceeds from Thai immovable property can be subject to Thai personal income tax/withholding rules; transfer fees, specific business tax or stamp duty may also apply. Annual Land and Building Tax depends on statutory classification, assessed value and available exemptions. Obtain a transaction-specific calculation before signing.
How long does the acquisition process take?
From first consultation to completed transfer, a typical acquisition takes 4–10 weeks. New-build purchases may have longer timelines depending on construction stage and project milestones.
Can I rent out the property when I'm not using it?
Possibly, subject to the property's rules and Thai law. Condominium regulations, lease terms, local permissions and hotel-licensing rules can restrict rentals, particularly short stays. Confirm the permitted rental model and tax treatment for the specific property before relying on projected income.
Do I need to be present in Thailand to complete the purchase?
Some transfers may be completed through a power of attorney accepted by the relevant Land Office, but form, execution, evidence and Land Office requirements vary. Confirm the current requirements for the specific transaction with independent Thai counsel and the competent Land Office.
Where are transaction fees confirmed?
The applicable signed mandate or engagement confirms brokerage, advisory and third-party costs, who pays them, and their payment triggers.
